• In common law, rape is an unlawful sexual intercourse with a female person by force and against her will. Today several jurisdictions have broadened rape to include sexual activity against a female or male victim, without consent, by either force or intimidation.

Modern statutes tend to replace the term rape with other more inclusive terms like sexual assault, sexual battery, criminal sexual conduct and similar. Violación, in contrast, remains to date the preferred term in the majority of countries where Spanish is spoken, with only a few exceptions.
